These Terms & Conditions (“Terms”) apply to your use of outaitcg.com and to orders placed with OUTAI TCG (“OUTAI TCG”, “we”, “us” or “our”). By using the website or placing an order, you agree to these Terms. Our Delivery & Returns Policy and Privacy Policy also apply.

1. About OUTAI TCG

OUTAI TCG is an independent retailer of trading card products and accessories. Unless expressly stated otherwise, we are not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Creatures Inc. or GAME FREAK inc. Product names and trademarks belong to their respective owners.

2. Eligibility and accounts

You must be legally capable of entering into a purchase contract in your country. If you are under the relevant age, a parent or legal guardian must place or approve the order. You are responsible for providing accurate account information, protecting your password and all activity under your account. Contact us promptly if you suspect unauthorised use.

3. Product information

We take reasonable care to present products accurately. Colours, packaging, promotional artwork and minor product details may vary by print run, region, screen or manufacturer. Images may include props for illustration; the written product description and selected variation determine what is included. Please check the language, edition, purchase unit, quantity and variation before ordering.

Unless a listing states otherwise, trading card products are sold as authentic retail products. The contents of sealed or randomised products are determined by the manufacturer. We do not guarantee particular cards, pull rates, grades, values or investment returns.

4. Prices, currencies and taxes

Prices and availability may change without notice before an order is accepted. Where the website displays prices in more than one currency or shows reference conversions, the checkout currency and final checkout total control. Your bank or payment provider may apply its own exchange rate or fee. Delivery charges, taxes and duties are shown where available; international customers remain responsible for charges not collected at checkout.

If a price, description, promotion or availability is clearly incorrect, we may correct it and contact you before dispatch. We may cancel and refund an affected order where we cannot reasonably fulfil it at the correct price or specification.

5. Placing and accepting orders

Your order is an offer to buy the selected products. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we dispatch the order or otherwise expressly confirm acceptance. We may refuse or cancel an order for reasons including stock shortages, payment failure, suspected fraud, pricing errors, delivery restrictions or breach of purchase limits. If payment has been taken for a cancelled order, we will refund the affected amount.

6. Payment

You authorise us and our payment providers to charge the payment method selected at checkout. You confirm that you are authorised to use that method and that the billing details are accurate. Payment timing may vary for pre-orders and payment services. We may carry out reasonable fraud and identity checks before accepting or dispatching an order.

7. Purchase limits and resale

To promote fair access to limited products, we may limit quantities per person, household, account, address or payment method. We may reduce or cancel orders that exceed a stated limit, appear automated or are reasonably suspected to be fraudulent. Separate written terms may apply to wholesale or business purchases.

8. Pre-orders

Pre-order release dates and expected quantities are estimates and may change. Orders containing pre-order and in-stock items may be held until all items are available unless we agree to split the shipment, which may involve extra delivery charges. Supplier allocations may be reduced or cancelled. If we cannot supply a pre-ordered item, we will offer an appropriate alternative or refund the affected item. 9. Delivery, risk and title

Delivery options and estimates are shown at checkout. Dates are estimates unless expressly guaranteed. Risk passes to you when the order is delivered to you or a person you identify, subject to applicable law. Ownership passes after we receive full cleared payment. International orders may be subject to customs duties, taxes and inspections. See our Delivery & Returns Policy for details.

10. Cancellations, returns and refunds

Your rights depend on your location and the product. Sealed, randomised and collectible products may lose return eligibility when opened or when a security seal is broken, except where the item is faulty or the law provides otherwise. Please review and follow our Delivery & Returns Policy before sending anything back. Nothing in these Terms limits mandatory consumer rights.

11. Promotions, discount codes and rewards

Promotions, discount codes, gifts and reward points may have additional terms, expiry dates, product exclusions and usage limits. They have no cash value unless required by law, cannot normally be combined and may be withdrawn or corrected where used fraudulently or issued in error. Returning an item may reduce or cancel rewards earned from that purchase and may require the return of a promotional gift.

12. Website use and intellectual property

You may use the website for lawful personal shopping. You must not misuse the website, interfere with security, introduce malicious code, scrape it at unreasonable scale, attempt unauthorised access, or use its content in a way that infringes rights. The website design, original text, graphics and OUTAI TCG branding are owned by or licensed to us and may not be copied for commercial use without permission.

13. Reviews and user content

If you submit a review, image or other content, you confirm it is accurate, lawful and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting the store. We may moderate or remove content that violates these Terms, but we are not required to publish every submission.

14. Third-party services and links

The website may use or link to services operated by payment providers, carriers, social networks and other third parties. Their services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.

15. Our responsibility

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud or for mandatory consumer rights. To the extent permitted by law, we are not liable for indirect or unforeseeable loss, business loss arising from a consumer purchase, changes in collectible value, or delay caused by events outside our reasonable control. Our responsibility for a product order will not exceed the amount paid for the affected products and delivery, except where the law requires otherwise.

16. Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, including carrier disruption, customs action, severe weather, natural disasters, industrial disputes, supplier failure, network outages or government action. We will take reasonable steps to reduce the effect and will contact affected customers where appropriate.

17. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order normally applies to that order. Updated Terms take effect when posted unless a later date is stated.

18. Governing rules and disputes

These Terms are governed by the mandatory laws and consumer protections that apply to your purchase. Nothing in these Terms removes any right you may have to bring a claim in the courts or dispute-resolution forum available in your place of residence.
